The Texas notary law that requires a notary seal to contain the notary’s ID number goes into effect on January 1, 2016 (Read at House Bill 1683).

When initially drafted, the bill was not intended to affect current notaries, but only to affect new and renewing notaries commissioned after January 1st.  Therefore, the Secretary of State’s office is NOT requiring existing notaries to obtain a notary seal with ID number until they renew their commission.

After reviewing the wording of the bill, the State Bar’s Real Estate, Probate & Trust Law Section “REPTL” announced that current notaries would be smart to replace their notary seals preemptively. The ambiguous wording of the bill could potentially put notarizations performed by current notaries at risk for legal challenges if their seals are not up-to-date with the new standards. To avoid having the legitimacy of future notarizations called into question, the State Bar of Texas is urging notaries to replace their current notary seals, if the seals do not already list their identification numbers. This could ultimately save you and your clients time, money, and worry.

In summary, current Texas notaries are NOT required to obtain a seal with an ID number until renewal, but have been advised by the State Bar’s Real Estate, Probate & Trust Law section that it would be the safest course of action.

We are currently monitoring two pieces of legislation that could require notary education for new and renewing Texas notaries. We will keep this page updated with any new information as it comes available. House Bill 1954 and Senate Bill 1037 are similar bills both entitled "An act relating to the education requirements for a notary public; authorizing a fee." House Bill 1954, introduced by Rep. Senfronia Thompson-Harris County (D), and Senate Bill 1037, introduced by Sen. Jose Rodriguez-El Paso (D), are companion bills that would require new and renewing notaries public toobtain notary training before their commissions could be issued or renewed. Budget Notary Bonding Agency supports and emphasizes the importance of notary education. If these bills become law, we will notify our Texas notaries about how and when to expect implementation. We understand the implications of an education requirement and are aware that certain types of training can be time consuming and costly. Budget Notary Bonding Agency wants to reassure our notaries that we are here to voice your concerns to the Secretary of State’s office.

NEW TEXAS NOTARY SEAL REQUIREMENT

Effective January 1, 2016

The Texas notary seal must contain the notary ID number effective January 1, 2016.  If you are a current Texas notary, you are not required to purchase a new seal until renewal (Secretary of State). All you need to do is sign and email, fax or mail your completed paperwork to us and your part is done. We will take care of the rest!

Applicants wishing to become a Texas notary or renew a commission must:

  • Be at least 18 years of age or older.
  • Be a legal resident of the State of Texas. (No certain length of time is required to establish residency.)
  • Must disclose a finding of guilt of any crime (other than a class C misdemeanor) from any jurisdiction regardless whether the case has been appealed. (An applicant who is currently on probation, has charges pending or on appeal, or who has been convicted of a crime of moral turpitude will be automatically denied.)
  • Effective September 1, 2009, non-residents living in a state adjoining Texas, who have qualified as a Texas escrow agent, are also eligible for appointment as a Texas notary.
